Below is the current legally authorized satutory Probate fees that Probate Attorneys normally charge for Probating an Estate in California. Keep in mind that all fees charged are based on the GROSS VALUE of the Estate, not the net. For example if the Estate consists of a home that has a value of $500,000 and a mortgage of $450,000, the Probate Attorney's fees are calculated on the gross value ($500,000), NOT the net value ($50,000).
|Attorney Charges:||Dollar Amount:|
|4% Of The First $100,000||$4,000|
|3% Of The Next $100,000||$3,000|
|2% Of The Next $800,000||$16,000|
|1% Of The Next $9,000,000||$90,000|
|0.5% Of The Next $15,000,000||$750,000|
Using an Estate with a $575,000 gross value as an example:
A Probate Attorney would charge 4% of the first $100,000, 3% of the next $100,000, and 2% of the next $375,000. So you would have ($4,000 + $3,000 + $7,500) for a total of $14,500. The Probate Attorney's fee to Probate this Estate would be $14,500.
